Preamble

 

The purpose of these general terms and conditions of use (hereinafter referred to as "GTC") is to determine the rules for using the website and the mobile application "SPOGEO" (hereinafter referred to as "the Application") which is published by SPOGEO.
SPOGEO" is a SAS company with a share capital of 15,000 euros, whose registered office is located at Parc plaza Hub Innovation 11, avenue de l'Harmonie, entrance B 59650 Villeneuve d'Ascq, registered with the RCS of Lille Métropole under number850 437 237.
SPOGEO" provides free access through a Facebook account, including Facebook Connect, to a social network that allows exchanges between athletes and between anyone who has an interest in sport through geolocation either through a website or a mobile application" which is available and downloadable free of charge in Apple's "App Store" and Google's "Google Play Store".
Any use of the site or the Mobile Application is subject to acceptance of these Terms and Conditions of Use (TCU) and the Privacy Policy.

 

By completing and validating the registration form, the User must read and accept these TCU. By accepting this agreement, the User undertakes to comply with the general conditions of use of SPOGEO, but also with the processing of his Personal Data. The applicable TCU are those in effect on the date of connection and use of the Site and Application by the User.
SPOGEO reserves the right to modify at any time, all or part of the TCU without prior notice or information for Users in order to adapt the TCU to technical developments in SPOGEO, but also to legal and jurisprudential developments. SPOGEO also reserves the right to modify the TCU for the implementation of new services.

Any modifications that may be made by SPOGEO to the TCU will be brought to the attention of Users by simply posting them online. They are considered as accepted by any User who accesses the Application as soon as it is put online. SPOGEO therefore invites all Users to regularly consult the TCU in order to be in agreement with them.

Article 1: Definitions
Terms beginning with a capital letter within these TCU, whether used in the singular or plural, shall have the following meaning:
● "Application" SPOGEO/ Mobile: refers to the site and the mobile application called
"SPOGEO" designed and provided by SPOGEO, providing access to the Services, which is available free of charge in Apple's "App Store" and Google's "Google Play Store" to be downloaded by the User on his Apple iOS and Android device.
● Profile Sheet: The Profile is linked to the User's Account, it is specific to each User of the SPOGEO Application.
● Spogeo Account: The Account is the place that is personal to each User on the application. An Account is created as soon as the User logs in and registers on the SPOGEO Application. This allows the User to access the Services offered by SPOGEO.
● Block/Remove user: A user can be blocked and/or deleted by another user. This allows Users to no longer be connected, and therefore to exchange messages.
● Hide a user: A User can hide another User on the news feed and/or the main page. This allows Users to no longer see Profiles that have already been crossed.
● Messaging (Chat): Only Users who have exchanged an agreement can initiate the action of sending messages to each other on the Chat (texts, messages, videos). Messages are stored in the Messaging section of each User's SPOGEO Account and the User, even offline, may receive messages. They will be archived pending their reading by the User at a later connection that will be established through the Internet network.
● "TCU": refers to these general terms and conditions of use of the site and the Application.
● "Content": refers, without limitation, to the structure of the site and the Application, the editorial content, drawings, illustrations, images, photographs, graphic charters, trademarks, logos, acronyms, company names, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content present within the site and the Application and/or any other element composing the site and the Application.
● "Services": refers to the various features and services offered by the site and the Application.
● "SPOGEO": refers to SPOGEO, a SAS with a capital of €15,000 whose registered office is located at Park Plaza, Hub innovation, 11 avenue de l'Harmonie, registered with the RCS of Lille Métropole under number 850 437 237.
● "User": refers to any natural person having access to the site, the Application and the Services.
● Personal data : The Personal Data that are collected when using the SPOGEO Mobile Application include first name, email address, gender, age, sports played, frequency of practice, level, main objectives, geolocation points between them, Users, geographical locations of practices, contact preference, Facebook ID, User Profile Notice, blocked and/or deleted Profiles, club or nonclub sports practice, licensed or not, strong side, left or right.
In addition, for the purposes hereof, the terms "Personal Data",
"Processing", "Data Controller", "Subcontractor" have the definition given to these terms in Article 4 of European Regulation 2016/679 of 27 April 2016 (hereinafter referred to as "GDPR").

Article 2: Acceptance of the TCU
To access the SPOGEO website and Application, its Content and Services and for its use, the User must accept these TCU without reservation. By browsing the site and installing the Application, the User accepts without condition or reservation all the T&Cs defined below. The These TCU therefore constitute a contractual agreement between the User and SPOGEO. In the event of refusal, the User undertakes not to use or access the site, the Application or its Services.

Article 3: Purpose of the SPOGEO website and Application
The purpose of the site and the Application is to provide the User with the following Services:
● Free access, through a Facebook Account, to a social network designed to allow exchanges between athletes and any other person with an interest in sport.
This description is not exhaustive and may be modified at any time by SPOGEO without any liability on its part.

Article 4: Conditions of availability of the site and the Application
The SPOGEO site and Application are made available free of charge to Users, excluding subscription costs with the mobile telephone operator and Internet connection and access costs.

Article 5: Access to the site, the Application, the Services - the functionalities
To access and use the Application and the SPOGEO site, the User must have a compatible telephone or mobile device and Internet access. The Application can be downloaded free of charge from the platforms
"App Store" and "Google Play Store" on the following mobile devices:
On iPhones using iOS 10 or higher, Android Smartphones using version 5 or higher. The SPOGEO application may automatically download and install updates from time to time or may require downloading and installation of updates or new versions so that the Application can still be used. The User acknowledges that some updates may reduce or delete features of previous versions of the SPOGEO application.
The site and Application provide SPOGEO Users with an intuitive and communicative framework that encourages exchanges with other Users in or near the site, sharing a common interest in the sport, in order to establish contacts. Each User is free to discuss and establish contacts with other Users in accordance with these TCU.
Under no circumstances may the Services offered by SPOGEO be considered as consulting or intermediary activities. They are intended solely to facilitate exchanges and contacts through the site or the Application according to the location and wishes of each User.
 
Article 6: Establishment of an Account
SPOGEO" provides free access through a Facebook account, including Facebook Connect, to a social network that allows exchanges between athletes and between anyone who has an interest in sport through geolocation, either through a website or a mobile Application" which is available and downloadable for free in Apple's "App Store" and Google's "Google Play Store" on the following mobile devices:
On Android Smartphones using version 5 or higher and on Phones Smartphones using version iOS 10 or higher.

To register on the Application you must have read and accepted the current Terms and Conditions and Privacy Policy.

As soon as the User has completed his Profile, SPOGEO authenticates for the User a Personal Account that contains the following information:
- A user profile
- A right to "notifications
- A right of current status
- An individual or grouped discussion thread

The user undertakes and guarantees not to create or use, under your own identity or that of a third party, any Accounts other than the one initially created.
The User also guarantees that all the information provided during registration is accurate and up to date. In order to create a User record, registration is done via Facebook Connect, which allows SPOGEO to use the first name, the age that is deducted from the date of birth and the User Profile photo.
Upon registration, the User agrees to comply with the current TCU and the Privacy Policy. He undertakes to respect the obligations for which he is responsible mentioned in these TCU.

Access to the Services available on the SPOGEO website and Application is available to any User. However, access to the Services requires the User to create an Account.
The User provides the required personal information for this creation (including first name, email address, gender, age, sports played, frequency of practice, level, main objectives......). When creating an Account, an SPOGEO User may request that his operation be linked to this Account.
The User may request at any time that his Account be deleted by activating this feature in the "My Profile", "Settings", "Delete My Account" section.

Article 7: Geolocation
The use of the geolocation functionality of the website and the Application requires the express prior consent of the User to be geolocated. In the event of consent, the User agrees that SPOGEO may collect its geolocation data whether or not the User uses the Application.
However, the user may, at any time, activate or deactivate the geolocation of the SPOGEO Application in the parameters of his computer or mobile device.
Disabling geolocation by the Application and/or geolocation of the computer or mobile device blocks all the functionalities of the SPOGEO Application.
The geolocation of the User is possible thanks to the GPS of his mobile phone. The mobile phone calculates the User's position itself.
The User's travel history will be kept by SPOGEO for a period of time proportionate and necessary for the purposes for which the data are collected and processed.

Article 8: Intellectual Property of the SPOGEO website and Application
SPOGEO is the exclusive owner of all intellectual property rights relating to the Site, the Application and its Content, subject to the rights of the companies licensed by SPOGEO.
Nothing in the TCU shall be construed as an assignment, transfer, sale, concession, license, loan, lease, license, operating authorization granted directly or indirectly by SPOGEO for the benefit of the User on the Site, the Application and/or the Services.

Article 9: Obligations of the User
The User expressly undertakes:
● not to reproduce permanently or temporarily the site or the application, in whole or in part, by any means and in any form;
● not to adapt, modify, translate, transcribe, arrange, compile, decompilate, assemble, disassemble, transcode, or reverse engineer all or part of the Site, the Application, the Services and/or the Content;
● not to use any software or processes to copy the Content of the Site or Application without the prior written permission of SPOGEO;
● not to export the Site or the Application, nor to merge all or part of the Site or the Application with other computer programs;
● to expressly renounce the use of software or devices likely to disrupt the proper functioning of the site and the Application, nor to take any action likely to impose a disproportionate burden on SPOGEO's infrastructures;
● not to extract or reuse, including for private purposes, without prior written authorization from SPOGEO, a substantial part or not of the Content of the databases and archives constituted by the site or the Application;
● not to set up systems likely to hack into the site or the Application and/or the Content in whole or in part, or likely to violate these TCU;
● to inform SPOGEO as soon as it becomes aware of an act of piracy and in particular of any illegal or non-contractual use of the site or the Application and/or the Content, regardless of the method of distribution;
● not to sell, rent, sub-license or distribute in any way the Site, the Application and/or the Content to third parties.

Article 10: Protection of personal data

Data processed :

As part of the use of the site and the Application, SPOGEO processes Users' Personal Data.
The information that the User communicates concerns the following data:
These are the basic data that are required during registration in order to access the Services of the site and/or the Application. Via Facebook Connect / Connect with Facebook, the data is retrieved by SPOGEO from Facebook to facilitate and accelerate the User's registration. By clicking on the "Connect with Facebook/Facebook Connect" button, the User accepts that Facebook may communicate this data to SPOGEO.
These data are related to the identity of the User and include
 
● Photography: At a minimum, it will be the Facebook Profile photo that is public. The User has the possibility to modify the photos and/or add other photos from his computer or smartphone to his Account.
● Date of birth: age is deducted from the date of birth which is visible to other SPOGEO Users.
● Gender (Male or Female)
● The first name of the User
 
The User may, if he/she wishes, provide other information that may better complete his/her Profile.
This other information is not mandatory, so it is optional. This optional information is provided at his discretion and under his sole responsibility.
The user can complete/modify his Profile directly on the site or Application and/or either via his Facebook Account by synchronizing it.

This information is mandatory:
If they are not provided, SPOGEO will not be able to provide the User with the Services offered by the Site and the Application and will be unable to create an Account on the Site and/or the SPOGEO Application.
   
When using the Services of the site or the Application with its functionalities, SPOGEO collects information concerning the User's activity. This is the registration date, last connection, type and number of interactions with other users, and with third party Accounts connected to his Account that will be available very soon.
 
The purpose of the Application or the SPOGEO site is to enable other Users/Sporters who are in the vicinity or who have been crossed via the site or the Application to be found in order to facilitate contacts and meetings. The use of the SPOGEO Service requires that your mobile device be geolocated. Subject to your express prior consent, SPOGEO may collect location data received from the mobile device you are using to indicate your location to other Users. Through this agreement SPOGEO will be able to access the position that is approximate of the User.
By geolocation, SPOGEO will be able to present the User Profiles it has selected that best match its search criteria.
   
SPOGEO collects certain information about the hardware and software on your computer or mobile device. This information includes IP address, mobile device model, browser type, device identification, language used, operating system version, domain names, application failures, advertising identifiers, access times and reference website addresses.
Use of the data
 
SPOGEO Services cannot be provided without SPOGEO processing data about you and other SPOGEO Users. The processing of the data you share with SPOGEO, including data about your geographical location, is essential to the Services we provide in order to also enable the site and Application that are offered to Users to operate properly because of the Service agreement between SPOGEO and the User.

Users' data are processed for the following purposes:
 
1. Creating and administering the Account for the User;
2. Geolocation in order to propose the Profiles of the Users they have chosen to select;
3. Sending communication messages relating to the Services or exchanges made with other Users (Notifications);
 
The data collected is also necessary for the achievement of SPOGEO's corporate purpose (Improve and optimize the Services with a better understanding of Users and how SPOGEO Services are operated). Your data can also be used to conduct satisfaction surveys, statistical studies, marketing type studies through the use of the site and the SPOGEO Application.
When the processing is authorised by the consent of the Users on their data processing, the Users can withdraw it whenever they wish.
If the User withdraws his consent, it does not affect the processing operations that were carried out prior to this withdrawal.

In the event of a request related to the law, including legality such as a search warrant, court order or other, SPOGEO may process Users' Personal Data.
SPOGEO may also process Users' Personal Data to comply with regulatory, legal, judicial or administrative obligations.  

SPOGEO may also process Users' Personal Data to discover or anticipate activities that may be fraudulent or that may impact the security of SPOGEO Services, in compliance with the law. SPOGEO can also analyze reports of Users who have behaved in violation of the TCU.
 
Data sharing
 
The sharing of SPOGEO data is governed by contract and in accordance with the law in force, and is subject to an adequate level of data security.
SPOGEO may enter into contracts with Service Providers and partners who may access and process some of the Users' Personal Data.
These partners and service providers, in cooperation with SPOGEO, help to operate and improve the Services that are offered.
In order to ensure the quality of our Services and to improve them, SPOGEO also produces general statistics in to which it is subject to anonymisation when the processing of personal data does not appear necessary for the production of statistics.
SPOGEO Services are also linked to advertising and marketing in order to submit messages, offers and Content that are intelligent and relevant to SPOGEO Users.
SPOGEO may also transmit certain data at the request of state agencies in order to comply with any request that may be judicial, legal or administrative.
 
Users' rights
 
In accordance with the amended law n°78-17 of 6 January 1978 relating to data processing, files, freedoms and the RGPD, you have the right to access, oppose, rectify, delete your personal data as well as a right to limit the processing carried out and to define the fate of your data in the event of death. The exercise of some of these rights may make it impossible for SPOGEO to provide you with access to the System or the use of all or part of the Services.
As SPOGEO is very attentive to the concerns of its Users, SPOGEO undertakes to respect the protection of Personal Data and to process its requests as soon as possible. The User may exercise his rights but must prove his identity by sending an email to userdata@SPOGEO.com or a letter by post.
You are reminded that you can exercise some of these rights directly through your device or account settings.
You have the right to file a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), the supervisory authority in charge of ensuring compliance with personal data obligations.
Finally, it is specified that SPOGEO may communicate your personal data, under the conditions provided for by law, to a duly authorised judicial or administrative authority.
 
● The User has the right to request the deletion of his Personal Data and the correction of his Personal Data that are erroneous or that may be obsolete ("right of deletion and right of rectification"). SPOGEO may retain certain User information when required to do so by law or when we have a legitimate reason to do so. This is the case, for example, if SPOGEO believe that you have committed fraud or violated our Terms of Use and SPOGEO want to prevent the user from circumventing the rules applicable to our community on our SPOGEO Application.
● The User also has the right to the portability of his data, i.e. the right to receive the Personal Data he has provided in a structured format, commonly used and readable by the machine and the right to transmit this data to another controller ("right to portability").
● The User also has the right to object at any time for reasons relating to his or her particular situation, the processing of his or her Personal Data for direct marketing purposes or the processing carried out on the basis of our legitimate interest ("right of opposition"). These rights may only be applicable within the limits of SPOGEO's resources when using Facebook Connect. Some of the data has been communicated to SPOGEO via Connect with Facebook/Facebook Connect and will not be able to be rectified as soon as the connection is made without Facebook's cooperation.
The User may also modify most of the data concerning him/her from the site or the Application himself/herself.
 
Data retention
 
SPOGEO stores the User's data that is necessary to use the User's Account, and archives it at the end of the following periods:

- 6 years after your last use of our Application and Website, if you have not closed your account.
- 1 year after the closure of your account, unless you have received negative notices or a report. If this is the case, your data are kept for 3 years following the last negative opinion or report.
- The content created by the User such as comments, opinions and ratings are made anonymous after the mentioned deadlines.
- In the event that your account has been suspended or blocked, we retain your data for a period of 3 to 9 years from the suspension in order to avoid any circumvention by you of the rules in force on our Application and Website.
 
SPOGEO undertakes to use all possible means at its disposal to guarantee optimal security of the data stored. Nevertheless, it is the User's responsibility to take the necessary and appropriate measures to protect his data.

Data transfer outside the EU
 
As part of the provision of the Services, SPOGEO may transfer your Personal Data to countries outside the European Union.
In this case, SPOGEO ensures that this transfer is carried out in accordance with the regulations in force by taking all appropriate measures and in order to ensure the confidentiality and security of this data under legal, technical and operational conditions and guarantees.

Article 11: Availability of the Site and the Application
SPOGEO undertakes to make its best efforts to secure access, consultation and use of the Site and Application Services. The Site and the Application are accessible 24 hours a day, 7 days a week except in the event of major force or an event beyond the control of SPOGEO and subject to any breakdowns and maintenance interventions necessary for the proper functioning of the Site and the Application. Maintenance interventions may be carried out without prior notification to Users.
SPOGEO is bound by an obligation of means regarding the accessibility, operation and/or availability of the Application, the site and/or the Services. SPOGEO reserves the right to interrupt, suspend or limit access to all or part of the Application and/or Services, in particular due to technical or legal constraints.

Article 12: Use of "cookies
The site may use "cookie" techniques.
A "cookie" is a small file, stored by the site or Application on the User's hard drive, containing information about the User's browsing habits.
These files make it possible to process statistics and traffic information, facilitate navigation and improve the Service for the User's convenience.
For the use of "cookie" files involving the saving and analysis of personal data, the User's consent is necessarily required.
This User's consent is considered valid for a maximum period of 13 (thirteen) months. At the end of this period, the site will again request the User's authorization to save "cookie" files on its hard disk.
The User is informed that he or she may oppose the recording of these "cookies" files by configuring his or her browser software.
In the event that the User decides to deactivate the "cookies" files, he/she will be able to continue browsing the site. However, any malfunction of the site caused by this manipulation could not be considered as being due to SPOGEO.
When browsing the site, the User is informed that third party cookies files may be stored.
In addition, the site and/or the Application integrates social network buttons, allowing the User to share his activity on the site and/or the Application. Cookies" files from these social networks may therefore be stored on the User's device when using these features.
The User's attention is drawn to the fact that these sites have their own privacy policies and general conditions of use that may differ from the site or Application. SPOGEO invites the User to consult the privacy policies and general conditions of use of these sites.

Article 13: Hypertext Links
The Site and the Application may contain hypertext links to third party websites that are not governed by these TCU.
SPOGEO has no control over the Content of third party websites referenced by hypertext links. These websites are published by third parties independent of SPOGEO. SPOGEO cannot therefore assume any responsibility for the content, advertising, products, services or any other information or data available on or from these sites. In Consequently, the User acknowledges that he/she is solely responsible for access to and use of his/her sites. SPOGEO cannot be held liable for any damage or loss, whether proven or alleged, resulting from or in connection with the use of or reliance on the Content, goods or Services available on these sites.

Article 14: Guarantees and Liabilities
The information provided on the site and the Application is provided strictly and exclusively for information and guidance. SPOGEO makes every effort to keep the Site, Application and Services up to date and to disseminate reliable, lawful and up-to-date information. However, SPOGEO cannot guarantee the integrity, accuracy, completeness, timeliness or other quality of the information provided on the site and the Application.
The User is solely responsible for the proper and judicious use of the Services made available to him/her on the site and the Application. SPOGEO cannot be held responsible for the direct and indirect, material or immaterial consequences that may result from the consultation, use and/or interpretation of the information and/or advice contained on the site or the Application by the User.

Access to and use of the Site and the Application is at the User's own risk. The Site and the Application are provided "as it is" and "as available" without warranty of any kind. It is the responsibility of all Users to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any breach. The User declares that he/she knows and accepts the characteristics and limits of the Internet network and, in particular, the functional and technical performance characteristics of the Internet network; problems related to connection and/or access to the Internet network and/or websites; problems related to network availability and congestion; problems related to network failure or saturation; problems related to transit time, access to information posted online, response times for displaying, consulting, querying or otherwise transferring data; risks of interruption; lack of protection of certain data against possible hijacking or hacking; risks of contamination by possible viruses circulating on these networks, etc. for which SPOGEO cannot be held liable.
SPOGEO cannot be held responsible:
● in the event of a defect, loss, delay or error in the transmission of data that is beyond its control;
● sending messages and/or data to a false, erroneous or incomplete address;
● if data were not received, for any reason whatsoever, or if the data it receives were illegible or impossible to process;
● in the event that the User is unable to access or use the Site, Application and/or Services for any reason whatsoever;
● if, for any reason, the connection is interrupted.
In addition, SPOGEO declines any responsibility in the event of misuse of the terminal and/or any incident related to the use of the terminal during the use of the site or of the Application. SPOGEO shall under no circumstances be held liable for any damage of any kind caused to Users, their terminals, computer and telephone equipment and data stored therein, nor for any consequences that may result from this on their personal, professional or commercial activity.
To obtain User status, it is indeed necessary to meet all the following conditions:
- complete the information in your Facebook Profile accurately and truthfully. The User must have given his first name, gender and date of birth attached to his civil status (and identity card). If the information is not accurate or false, the User must undertake to correct any errors on his Account. He can correct these errors via the Application or directly on his Facebook Profile where he must activate the synchronization of information between his Facebook Profile and his Account. The User also endeavours to provide an email address that is valid;
- Undertake to regularly update the information provided by his Account from the website or Application;
- Have read and become informed about the current TCU and comply with them by validating their registration.

By using the SPOGEO Service and in order to remain an SPOGEO User, you agree to comply with the following:
- Do not use the SPOGEO Service for any purpose that is unlawful or prohibited by this Agreement.
- Do not use the SPOGEO Service for malicious or malicious purposes.
- Do not use the Service to undermine SPOGEO.
- Do not send junk mail, solicit money from any users or scam them.
- Do not imitate any person or entity or publish any images of another person without their permission.
- Do not persecute, track, intimidate, attack, harass, abuse or defame any person/User on the SPOGEO mobile application.
- Not to publish any content that violates or infringes anyone's rights, including publicity rights, privacy, copyright, trademark or other intellectual or contractual property rights.
- Do not post any content that may be hateful, threatening, sexually explicit or pornographic. Speech that may also incite violence or contain nudity, graphic or gratuitous violence.
- Do not publish content that includes racist, intolerant, hateful or promotes physical violence against a particular group or person.
- Do not solicit passwords for any purpose whatsoever, or information that allows personal identification for commercial or illegal purposes from other Users or to distribute another person's personal information without their permission.
- Do not approach other Users in order to promote paid products or Services.
- Do not use another User's account.
- Not to advertise or induce in any way to use any other Service, whether competitive or not, and not to commit any unfair competition offence.
- Do not use the Application to organize events.
- Do not create another account if we have already terminated your account, unless you have permission from SPOGEO.

SPOGEO grants each User a license for personal purposes. By using the SPOGEO Service and in order to remain an SPOGEO User, you agree to comply with the following:

-Do not use the Service or any content of the Service for commercial purposes without our written consent.
-Do not copy, modify, transmit, create derivative works from, use or reproduce in any way any copyrighted material, images, trademarks, trade names, service marks or other intellectual property, proprietary content or information accessible through the Service without SPOGEO's prior written consent.
-Do not disclose information that does not appear on your SPOGEO profile such as phone number, address or last name.
-Do not disclose your personal details after a reasonable period of time.

-Do not use the SPOGEO Service in any way that could interfere with, interrupt or harm the SPOGEO Service, servers or networks connected to the Service.
-Do not download viruses or other code that may be malicious and compromise the security of the SPOGEO Service.
-Do not copy or reproduce any part of the SPOGEO Service without the prior written permission of SPOGEO.
-Do not use or develop any applications that interact with the SPOGEO Service or the content, information of other Users without the written consent of SPOGEO.
-Do not use, access or publish the SPOGEO application programming interface without our written consent.
-Do not probe, scan or test the vulnerability of our SPOGEO Service on any system or network.

SPOGEO may investigate and take any possible action with respect to illegal and/or unauthorized use of the Service, including termination of the User's account.

Any software we publish can automatically download and install improvements, updates or other new features. You can change these automatic downloads that are in your device settings.

The User is solely responsible for his actions and the data he publishes on the Application or website.
SPOGEO assumes no responsibility for any content that the User, or another User publishes, sends or receives through SPOGEO's services.
Access to any material downloaded or obtained through the use of the SPOGEO service is at your sole discretion and risk.
SPOGEO assumes no responsibility for the conduct of the User or that of a User through the SPOGEO service.

SPOGEO reserves the right to review and delete any content that violates this agreement. As a reminder, SPOGEO cannot guarantee that all content will comply with this agreement. If you see any content on the Service that violates this Agreement, please report it on the Service or to contact@spogeo.com.

The equipment (hardware or software) that is necessary to access the Services as well as all other related costs, including telecommunications costs, are the sole responsibility of the User. The User is solely responsible for the equipment he or she uses in connection with the Service.

SPOGEO warns Users who wish to have real meetings. It is the total responsibility of Users to control and verify the identity of the persons with whom they organize real meetings. The conduct of these meetings, which move from virtual to real, is organized under the sole responsibility of the users and has no link with SPOGEO. All this is the sole responsibility of the Users. SPOGEO cannot be held liable for any acts or problems that may result from it.
As a security measure, SPOGEO strongly advises to organize real meetings only in public places that are heavily frequented or to inform a relative.

It is recalled that Users have the possibility to Block/Delete a User. This allows Users to no longer be connected, and therefore to exchange messages. The User can reverse his decision, by unchecking the Users he has previously blocked. Users also have the option to Hide Users on the news feed and/or main page. This allows Users to no longer see Profiles that have already been crossed. The User can reverse his decision, by unchecking the Users he has previously hidden.

Article 15: Evolution of the TCU
The applicable TCU are those in effect on the date of connection and use of the Site and Application by the User.
SPOGEO reserves the right to modify at any time all or part of the TCU without prior notice or information to Users in order to adapt them to changes in the Services, technical, legal and jurisprudential developments or the implementation of new services. Any modifications made by SPOGEO to the TCU will be brought to the attention of Users by simply posting them online. They are considered as accepted by any User who accesses the site or the Application. SPOGEO therefore invites all Users to consult the TCU regularly.

Article 17: Applicable law
The current TCU are subject to the laws in force in France.
In the event of disagreement, the User undertakes to contact SPOGEO in order to try to resolve any dispute amicably.
If there is no agreement reached, the User is informed that he or she may choose to use an intermediary free of charge to reach an agreement and that he or she may submit complaints if there are any on the dispute resolution platform put online by the European Commission:
http://ec.europa.eu/consumers/odr/.

The European Commission will refer the complaint to the competent national ombudsmen. In accordance with the rules applicable to mediation, you are required, before any request for mediation, to have previously notified SPOGEO in writing of any dispute in order to obtain an amicable solution.
Any conflict or dispute that is related to the current TCU that cannot be resolved amicably will be referred to the competent courts in Lille.
